Terms and Conditions

1. Definitions
In these general terms and conditions, the following terms are used in the following meaning, unless expressly stated otherwise:
- MyMenu: The online platform (website/app) offered and legally managed by Windata, located at Dynamicalaan 14, 2610 Antwerp, Belgium, registered under company number BE 0835.139.217. Where these terms refer to 'MyMenu', the legal entity Windata is meant.
- Customer: The natural or legal person who places an order via the Platform.
- Restaurant: The company that prepares and/or sells meals, drinks, and related items, and concludes an Agreement with the Customer via the Platform.
- Agreement: The agreement between the Customer and the Restaurant regarding an Order and its delivery or collection.
- Platform: The website(s), apps, and other tools of MyMenu through which the service is offered.
2. Applicability
These general terms and conditions apply to every offer from MyMenu, to every order placed via the Platform, and to the formation of the Agreement between the Customer and the Restaurant.
3. The Role of MyMenu
MyMenu offers an independent platform where Restaurants can offer their meals and Customers can order them. MyMenu solely facilitates the formation of the Agreement between the Customer and the Restaurant. MyMenu is not a party to the Agreement for the delivery of the meals and is not responsible for the quality of the delivered products or the delivery (unless expressly stated otherwise).
4. The Offer and the Order
- The offer on the Platform is compiled based on the information provided by the Restaurants. MyMenu strives for the most accurate representation possible but cannot guarantee the absolute accuracy of (for example) allergen information or images.
- The Agreement between the Customer and the Restaurant is concluded at the moment the Customer definitively places the order via the Platform and receives an electronic confirmation thereof.
- The Restaurant is entitled to cancel the order, for example in the event of force majeure or if ingredients are out of stock. The Customer will be informed of this as soon as possible.
5. Prices and Payment
All prices on the Platform include VAT and exclude any delivery costs or service fees, unless stated otherwise. Payments can be made online via the payment methods offered on the Platform, or in cash upon delivery (if the Restaurant allows this option).
6. Right of Withdrawal
Given the nature of the products (meals that can spoil or age quickly), the statutory right of withdrawal (the right to cancel an online purchase within 14 days) does not apply to orders via MyMenu, in accordance with Article VI.53 of the Belgian Code of Economic Law.
7. Complaints Procedure
Complaints about the order or delivery should initially be reported directly to the relevant Restaurant. If the Customer and the Restaurant cannot resolve the issue together, or if there is a complaint about the Platform itself, the Customer can contact MyMenu's customer service via [email protected].
8. Applicable Law
Belgian law applies exclusively to these terms and conditions and all agreements. Any disputes will be submitted to the competent courts of the district of Antwerp.
